Only those who are able to legally bind contracts under the Indian Contract Act of 1872 are permitted to use the site. The Indian Contract Act, 1872 prohibits the use of the Platform by those who are "incompetent to contract," including minors, insolvents who have not been dismissed, etc. You may not sign up as a vendor on the platform, conduct business there, or use the platform in any other way if you are a minor, that is, under the age of 18. If it comes to BLS ’s attention or it is determined that you are under the age of 18, BLS retains the right to cancel your registration and/or deny you access to the Platform. When you register as a company.

BLS E-services Limited

Bls E-Services Limited referred to as BLS is the ICT enabled platform provider in the name of “BLS Store” Mobile application and connects with BLS STORE owner and Company or Company Distributor for selling of various goods only.

Company and Companies Distributor

All the terms and conditions to be followed and implemented by the Company and Companies Distributor associated with BLS for selling of products on BLS store application.

• All the products supplied by the Company and Companies Distributors should be genuine and hold up good quality.
• No scam of quality or quantity exchange should be run by the Company and Companies Distributor, if so, Company and Companies Distributor found guilty would be prosecuted.
• If the items sold include any perishable goods, it should be delivered freshly.
• Products like, cigarettes, alcohol, Tobacco Products and any other products banned by Central or respective state governments are strictly prohibited through BLS Store
• Products of category like banned/counterfeit/refurbished shall not be listed on BLS STORE application.
• All supply/logistics/insurance/ warranties/ guarantees related shall be sole responsibility of of goods lies with Company or Company Distributor.
• A proper receipt should be provided by the Company and Companies Distributor stating a proper balance/statement of the product purchased/sold.
• Proper packaging of the product should be initiated by the Company and Companies Distributor to avoid any kind of damage to the goods.
• There should be proper sanitization of the product before handling it to the BLS Store.
• NO product should be taken out for delivery without proper date and address or contact info.
• As soon as the order is placed the local Company and Companies Distributor should try to send fresh products, No Company and Companies Distributor should compromise on the quality of food items.
• Before packing the manufacture date, expiry date of the products should be checked by the Company and Companies Distributor.
• There should be 100% authenticity of the products, Company and Companies Distributor must ensure the products are genuine and hold a mark of quality.
• All Statutory requirements need to be fulfilled by Company and Companies Distributor like FSSAI/GST/Registration Certificate etc whichever is applicable to his business.
• We don't allow Company and Companies Distributor to supply counterfeit goods.
• The replacement and return policy will be as per the arrangement with BLS Store

BLS Store APP

• BLS Store App is only for the purpose of delivering goods to the rural areas, no BLS Store should use it for personal benefit.
• No frauds or malfunction should be carried out by any BLS STORE, if such actions come under notice there would be a legal action taken.
• There should be no exchange or mishandling of the products.
• There will always be a time limit for edible goods to be delivered; BLS STORE should make sure the products are delivered in a proper span of time.
• If the products out for delivery be late then actions would be taken against BLS STORE, only a genuine case will be considered. Recipient will have to provide the secure code received on registered mobile number for acknowledgment.
• Replacing, replicating or duplication of the products is strictly prohibited by both Vendors and BLS STORE. If held responsible strict actions will be taken.
• The contact information of the consumer is only for the delivery purpose.
• No BLS STORE should try to contact or misuse the Information of the consumer, if found so they would be legally prosecuted. Under right to personal information.
• There should be a proper receipt provided with the delivery package of goods to the consumer.
• There should be strict professionalism while dealing with the consumer and the BLS STORE should guide and answer to the query of the consumers.
• BLS STORE carrying any sort of illegal activities will be prosecuted and their Store would be dissolved.
• A proper record of Transactions to be maintained by each and every BLS STORE to avoid any confusions or mishaps.
• BLS STORE should ensure the product has been delivered to the person who ordered it / better to take a confirmation from the consumer.
• BLS STORE to hold Utmost sincerity and honesty for the service.
• Products like cigarettes, alcohol, Tobacco Products and any other products banned by Central or respective state governments are strictly prohibited through BLS Store App.
• The Digital Cadets/Delivery Boys appointed by BLS Store, BLS STORE/Store Incharge should be properly trained on Behavioral Skills in dealing with customers and also BLS STORE need to take a police verification certificate of Cadet.
• All Statutory requirements need to be fulfilled by Company and Companies Distributor like FSSAI/GST/Registration Certificate etc whichever is applicable to his business.
• BLS Store BLS STORE will be responsible for Quality of Products, Quantity of Products, Packaging of Products, Replacement Policy and Return Policy as per their local model. The same need to be communicated to customers.
• BLS STORE need to Ensure they follow the guidelines of companies with whom BLS Store Partners, for Distribution through BLS Store App.
• This is the Refund policy & Replacement, return & shipping policy for the products you buy through the BLS STORE App.

Refund policy

Money shall be refunded to BLS Store if any order is cancelled or not accepted by the Company or Company Distributor in the app or website by BLS.

If any BLS STORE cancels the order before acceptance by the company or company distributor, the amount will be refunded within 3 working days in BLS STORE account.

Any discrepancy related to refund can be raised to store@blssewa.com. .

Replacement policy

Any damaged product will be replaced according to the terms and conditions of the Company and Companies Distributor. Any support related to replacement can be raised a grievance in the app.

Return policy

Product shall NOT be returned unless it is mentioned in the application by the Company or Companies Distributor.

Shipping Policy

The Order will be delivered to the BLS STORE as per defined time frame in MoU from the date of order.

For Account Closure and Restart the account

According to our policy, if a Company or Company Distributor requests the closure of the account, the account will be placed on hold for a period of 90 days to ensure the orderly closure of transactions that have been made prior to his closure request, and this will be available to the said Company or Company Distributor for downloading payment and taxation reports, as needed. The Company or Company Distributor would have to get in touch with us after 90 days to confirm that he has obtained the reports and ask to have his account deactivated once more. The Company or Company Distributor account will be deleted following receipt of this confirmation, providing there are no unpaid invoices from the seller. BLS will always preserve the Company or Company Distributor registered phone number, registered email address, GSTIN, and other information.

Use of the Platform

BLS Store platform is merely an intermediary and does not interfere in the transaction between BLS STORE and Company and company Distributor.

User will agree, undertake, and confirm that use of the platform shall be strictly governed by the following binding principles:

1. You are forbidden from hosting, displaying, uploading, changing, publishing, sending, updating, or disseminating any data or images that:

• belonging to someone else and over which you have no authority;
• is blasphemous, defamatory, bigoted, obscene, pornographic, pedophilic, libelous, invading another person's privacy, hateful, or racially or ethnically objectionable, disparaging, related to or encouraging money laundering or gambling, or otherwise unlawful in any way, whatever, or unlawfully threatening or harassing, including but not limited to ‘indecent representation of women’ within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;
• is untrue, incorrect, or deceptive in any way.
• is clearly offensive to the online community, such as sexually explicit content or content that promotes obscenity, paedophilia, racism, bigotry, hatred, or physical damage of any type against any group or individual.
• harasses or promotes harassment of another individual.
• encourages unlawful activities or behaviour that is violent, threatening, offensive, defamatory, or libellous.
• breaches or infringes upon the rights of any third party, including but not limited to those of publicity, privacy, or intellectual property (including without limitation, the unauthorised disclosure of a person's name, email address, physical address, or phone number).
• encourages the unauthorised or illegal reproduction of another person's copyrighted work (see "Copyright complaint" below for information on how to file a complaint about uploaded copyrighted material). Examples of this include the distribution of pirated computer programmes or links, information on how to get around copy-protection features installed by manufacturers, and pirated music or links to pirated music files.
• has password-protected or restricted access pages, hidden pages, images, or links to any other pages (those not linked to or from another accessible page).
• makes available content that inappropriately uses people in sexual, violent, or other ways, or asks for personal information from anybody.
• offers guidance on how to engage in unlawful crimes such making or purchasing illicit weapons, invading someone's privacy, or selling or producing computer viruses.
• includes unauthorised recordings, pictures, or depictions of another person (whether an adult or a minor);
• tries to obtain unauthorised access to the Platform, profiles, blogs, communities, account information, bulletins, friend requests, or other parts of the Platform, or solicits passwords or personal identifying information from other users on the Platform for commercial or unlawful reasons.
• engages in commercial activities and/or sales such as contests, sweepstakes, barter, advertising, pyramid schemes, or the buying or selling of 'virtual' products relating to the Platform without our prior written approval.

2. You may not access, obtain, copy, monitor, or otherwise replicate any portion of the Platform or any content using a "deep link," "page-scrape," "robot," "spider," automatic device, programme, algorithm, technique, or other similar or analogous manual process, or in any way to tamper with, compromise, or attempt to interfere with the Platform's navigational structure, display, or any content. We hold the power to prohibit such behaviour.

3. You may not use hacking, password "mining," or any other illegal methods to gain unauthorised access to any part or feature of the Platform, other systems, networks linked to the Platform, server, computer, network, or the services made available on or through the Platform. Accessing, acquiring, copying, monitoring, or otherwise reproducing in any way any part of the Platform or any content, or attempting to do so, in order to obtain or attempt to obtain any materials, documents, or information through any means other than those that are specifically made available through the Platform. We retain the right to forbid any such actions.

4. You are not permitted to break the security or authentication mechanisms on the Platform or any network linked to the Platform, or to probe, scan, or test the vulnerability of the Platform or any network connected to the Platform. You may not use the Platform, any service, information made available, or offered by or through the Platform in any way where the goal is to reveal any information (including but not limited to personal identification or information other than your own information). You may not reverse look-up, trace, or seek to trace information on any other user of or visitor to the Platform (including any account on the Platform that is not owned by you), or to its source.

5. You must not engage in any conduct or actions that might damage the reputation of BLS or the platform's sellers or otherwise damage or dilute any BLS trademarks, service marks, trade names, and/or goodwill associated with such trademarks, service marks, or trade names as may be applicable. This includes using the terms or BLS International in any negative, derogatory, or defamatory manner. You commit to refraining from taking any action that places an excessive or disproportionately significant strain on the Platform's infrastructure or the systems and networks of BLS or any other systems and networks linked to BLS Store.

6. You hereby undertake not to use any tool, programme, or procedure to disrupt or attempt to disrupt the correct operation of the Platform, any activity occurring on the Platform, or the use of the Platform by any other person.

7. Any message, transmission, or service you send to us on or through the Platform cannot have its origins covered up using fake headers or other identification manipulation. You are not allowed to pose as, speak for, or represent another person or organisation in any way.

8. You are not allowed to use the Platform or any content for any activities that are against the ToU or illegal, or to encourage others to engage in illegal or other activities that violate the rights of BLS and/or third parties.

9. You will be responsible for providing information about the things or services you want to sell on a regular basis. You promise that every piece of information in this regard will be true and accurate. You must not exaggerate or overstate the attributes of such things or services in order to deceive other Platform users.

10. You agree not to advertise or solicit other sellers on the Platform to buy or sell any products or services, including but not limited to those linked to what is posted on the Platform. You are not permitted to send chain emails, unsolicited commercial email, or other types of junk mail to other users who have access to the Platform. It is against the terms of service to contact, advertise to, sell to, or solicit anybody other than those who have opted to buy from you using any information you have got on the platform. You acknowledge that we reserve the right to share any information (including the identities of anyone who have supplied information or content on the Platform) as necessary to comply with any law, regulation, or legitimate governmental request. This could, for example, entail disclosing the information in connection with a probe into alleged unlawful activity, its solicitation, and/or in response to a valid court order or subpoena. Additionally, we may disclose any information about you to law enforcement or other government officials as we, in our sole discretion, deem necessary or appropriate in connection with the investigation and/or resolution of potential crimes, particularly those that may involve personal injury. We reserve the right, but have no responsibility, to monitor the material uploaded on the Platform. Any content that violates or is claimed to violate any relevant law or the letter or spirit of the ToU may be removed by BLS at its sole discretion. Despite this, YOU REMAIN SOLELY RESPONSIBLE FOR THE CONTENT OF THE MATERIAL YOU POST ON THE WEBSITE AND YOUR INDEPENDENT, REGARDLESS OF FORM, COMMUNICATION WITH THE BUYERS AND THE OTHER SELLERS. Please be aware that such content does not represent the opinions of BLS . BLS will never assume or be liable for any content posted on the Platform or for any claims, losses, damages, or expenses related to its use or display on the Platform.

11. Other users (including unauthorised persons or "hackers") may publish or send offensive or obscene material on the Platform, and you may be unwillingly exposed to such material. Due to your use of the Platform, it is also possible for third parties to find out personal information about you and use it to harass or harm you. However, by using the Platform, you understand and accept that we are not responsible for the use of any personal information that you publicly publish or share with others on the Platform. We do not consent to such unauthorised uses. Choose the information you post on the Platform with others and with the public with care.

12. BLS reserves the right to take any necessary action and recover any damages that may result from your involvement/participation in DoS (denial of service) / DDoS, whether on your own or through a group(s) of persons, intentionally or accidentally (Distributed Denial of Services).

Selling (Company and Company Distributor)

As a registered seller, you must list item(s) for sale on the Platform in compliance with the policies included by reference in this ToU.

You must be legally qualified to sell the item(s) you post for sale on our Platform, as well as possess all relevant licenses and permits. The mentioned items must not violate any third parties' intellectual property, trade secrets, other proprietary rights, or rights of publicity or privacy. Only text descriptions, graphics, images, or videos that describe your item for sale are permitted in listings. Each item must be listed on the Platform in the proper category.

To ensure success, all stated things must be kept in stock. On the Platform, all objects must be classified in the relevant category. For the sale to be fulfilled successfully, all mentioned items must be kept in stock. The goods must be accurately described in the listing description, which cannot be misleading. You consent to returning any money you may have received from the buyer if the item description does not reflect the actual condition of the item. You consent to not listing the same product on the Platform more than once in different quantities. You may list the same item more than once in different categories, but BLS has the right to remove all such listings.

BLS has the right to impose restrictions on the sale of goods coming from particular nations.

Compliance on selling of goods/services

You must also ensure that the provisions of the Integrated Goods and Services Tax (IGST), Central Goods and Services Tax (CGST), Union Territory Goods and Services Tax (UTGST), or State Goods and Services Tax (SGST) apply to the goods/services you provide.

It is your responsibility to charge applicable goods and services taxes on the supplies made and to remit such taxes to the government. Any shortcomings and/or omissions on your side are not the responsibility of BLS.

In the event of any mismatches due to tax collection at source, you will be expected to supply BLS with all applicable information for BLS to correspond with the relevant authorities, and any liability incurred because of omission will be your responsibility to pay such deficiency.

For each product listing, you must include the associated Harmonised System Nomenclature (HSN) code number. If you don't give the HSN code number, the product in concern will be taken off our site and you won't be allowed to sell it there again.

In the event of a disagreement between the terms of this clause and any other clause in these terms of use, the provisions of this clause will receive priority.

Content Posted on the Platform

All text, graphics, seller interfaces, visual interfaces, photographs, trademarks, logos, sounds, music and artwork, notes, messages, emails, billboard postings, drawings, profiles, views, ideas, images, videos, audio files, other material or information (collectively 'Content') are generated by third parties, and BLS has no duty or liability for such third-party generated Content because BLS is just an intermediary for the purposes of this ToU. Without BLS's prior written authorization, no portion of the Platform, including the Content, may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or transferred in any way (including "mirroring") to any other computer, server, website, or other medium for publishing, distribution, or other commercial enterprise. You may use the information on the products and services made available on the Platform for downloading provided you:

• Do not delete any proprietary notice text from all copies of the Content.
• Use such Content solely for non-commercial, personal informational purposes; do not broadcast or copy it to any medium or post it on any networked computer.
• Don't alter any Content in any way; and
• Don't offer any extra guarantees or claims on the content.

You are solely responsible for any Content that You upload or send on the Platform. You hereby grant us the worldwide, perpetual, royalty-free, and transferable rights in and to the Content, which shall become our sole and exclusive property. We shall be permitted to use the Content or any of its elements for any kind of purpose forever, including, but not limited to, promotional and advertising purposes in any media, whether now known or hereafter devised, or the creation of derivative works, consistent with our privacy policy as adopted in accordance with applicable law. You acknowledge that any content you provide may be used by us in accordance with this TOU, and that you will not be paid or otherwise compensated for such use.

Compliance with Laws

Company or Company Distributor should sign an undertaking confirming that they have obtained and will continue to maintain in force all relevant licenses, permissions, authorizations, and permits required to distribute, market, supply, and sell the [*] ("Products") on BLS Store application, under applicable laws, including the Food Safety and Standards Act, 2006, Food Safety and Standards (licensing and registration of food business), Regulations, 2011 and other related legislation or any other certification or license’s required thereof.,The undertaking is still true and accurate in every way for the entire period that the seller may advertise, distribute, market, provide, or sell the Products on BLS Store application . Additionally, the seller must promptly send a written notice to BLS upon the expiration of the FSSAI License and/or any other certifications or Licenses upon receiving any orders, demands, warrants, documents, or regulatory actions pertaining to the FSSAI License and/or any other certifications or Licenses.
